What a default judgment is when a merchant does not answer an MCA lawsuit or summons, how it differs from a confession of judgment, and what "vacate" language means at literacy level only. Counsel-first. Not a DIY vacatur recipe.

Short answer
A merchant cash advance default judgment (also searched as MCA default judgment or default judgment MCA) is usually a court judgment entered because the merchant or guarantor did not appear or answer the lawsuit in time. It is a court outcome. It is not the same as "defaulting on the advance" under the purchase agreement, and it is not the same as a confession of judgment (a pre-signed warrant-of-attorney path that can skip a normal contested case where state law still allows it).
People also search merchant cash advance lawsuit default judgment when papers are already in play, and vacate MCA default judgment when someone talks about asking a court to set a judgment aside. Those phrases need literacy, not a blog recipe. If a summons, complaint, hearing notice, restraining notice, or judgment is already on your desk, preserve every deadline and speak with a licensed attorney in the right venue. MCA Clarity is not a law firm and does not give legal advice.

Default judgment vs confession of judgment
These two phrases get mashed together in sales calls and panicked group chats. Keep them separate.
Default judgment (failure to answer)
In a contested lawsuit path, the plaintiff serves a summons and complaint. The defendant generally must answer or otherwise respond by a deadline on the papers (or the court's rules). If nobody responds in time, the plaintiff may ask the court to enter a default judgment. Silence is treated as a reason to enter judgment without a full trial on the merits. Exact procedure depends on the court and the papers. Education only: your attorney reads your summons.
Confession of judgment (pre-signed path)
A confession of judgment (COJ) in an MCA contract is a different machine. Where still permitted, it is typically a clause or affidavit signed up front that can let a creditor seek judgment faster than a fully contested case, sometimes with little or no ordinary appearance by the merchant. That is the warrant-of-attorney style path. It is not "you forgot to answer a summons." Start at confession of judgment in MCA contracts. Open COJ New York or COJ Pennsylvania only if your papers or contract actually point there.
Why the mix-up happens
Collectors blur "you are in default," "we will get a judgment," and "you signed a confession." Contract default, lawsuit service, default judgment for non-appearance, and COJ entry are four different ideas. Sorting which one you face is the first job for counsel or, pre-suit, careful document review.
How summons can become a default judgment (high level)
Literacy sketch only, not a playbook for any one court.
- Pre-suit pressure. Missed ACH and collections outreach often come first (collections, demand letter). A demand letter is usually not a summons.
- Lawsuit filed. A complaint and summons issue. Venue clauses often point to commercial forums; that is literacy, not a promise about your residence. See the lawsuit guide.
- Service. Keep envelopes, affidavits of service, email headers, and portal screenshots. How papers were delivered can matter later.
- Response window. The summons and local rules set a deadline to answer, appear, or move. Missing that window is how many default judgments happen.
- Application for default judgment. If no timely response is on the docket, the plaintiff may ask the court to enter judgment for a claimed sum, fees, and costs as the papers allow.
- Entered judgment. The case is no longer just "a claim." A sum is owed unless later vacated, modified, satisfied, or otherwise resolved under court process.
Contract default on remittances can run in parallel with a lawsuit. You can be "in default" under the purchase agreement and face a default judgment if you do not answer. Do not collapse those words into one event.
What enforcement talk often means
After a judgment, collectors often mention tools local procedure may allow: abstracts of judgment, restraining notices, levies, garnishments where permitted, information subpoenas, judgment liens, and continued use of any UCC lien already filed. Which tools exist depends on the court and state. We do not invent a universal enforcement checklist.
Before judgment hardens, pressure often looks like collections and demand letters. After judgment, talk usually shifts to enforcing what the court entered. If someone says "judgment" while you only have a demand letter, ask which court, which docket number, and whether anything is entered. Verify with counsel or the court portal. Guarantors named in the suit can face the same deadlines. Once papers exist, see MCA debt settlement lawyer and merchant cash advance attorney.
What "vacate" language means (literacy only)
Search traffic for vacate MCA default judgment is real. In plain English, "vacate" usually means asking a court to set aside or undo an entered judgment (or a default) under that court's rules. Merchants hear the word from friends and salespeople who imply it is an online form.
Literacy only:
- Vacatur is a court process on the docket that entered the judgment, not a settlement company's product name.
- Courts generally care about service, whether a deadline was missed for a reason the rules recognize, whether a defense was never heard, and timing. Standards vary by venue. We will not invent a step list, success rate, or timeline.
- Talking about vacatur is not winning vacatur. Counsel in that court reads the judgment, the affidavit of service, and the local rules.
- Settlement or satisfaction of a judgment is a different fork from vacatur. Paying or negotiating is not automatically "vacating" it.
Contract-default searches belong on what happens if you default on a merchant cash advance. COJ clause searches belong on the COJ hub. Entered default judgment: counsel first.
If you are still pre-judgment: the negotiation fork
Not every stressed remittance file is already a judgment. If you have missed ACH pulls or a demand letter, but no summons yet, you may still be in a negotiation window. That window can close when a suit is filed, a response deadline passes, or a judgment enters.
Pre-judgment research often means mapping every advance, guarantee, UCC filing, and default notice (merchant cash advance agreement), comparing MCA debt relief and MCA debt settlement without treating brochure savings as a promise, and watching for lawsuit or COJ language so you leave the settlement sales funnel once papers arrive.

FAQ
What is a merchant cash advance default judgment?
A court judgment often entered when the merchant or guarantor does not answer or appear in time. Separate from contract "default" on remittances. Education only.
Is a default judgment the same as a confession of judgment?
No. Default judgment usually follows a missed response to a summons. A confession of judgment is a pre-signed path that can seek judgment faster where still allowed. See the COJ guide.
What does "vacate a default judgment" mean?
Asking the court that entered the judgment to set it aside under that court's rules. No DIY recipe, success rate, or timeline here. Counsel in that venue.
How is this different from defaulting on the MCA itself?
Contract default is about the purchase agreement. Default judgment is a court outcome after suit. See what happens if you default on a merchant cash advance.
Does an industry "default rate" tell me my judgment risk?
No. See merchant cash advance default rate.
What should I do if I was just served?
Do not ignore the deadline. Preserve every page. Contact a licensed attorney promptly. Settlement research does not replace answering the suit. Process literacy: lawsuit guide.
Can a demand letter become a default judgment by itself?
Usually no. A demand letter is typically pre-suit. A default judgment generally needs a filed case, service, and a missed response. Verify what you received: demand letter.
